Lilly Endowment Gives $10 Million to American Red Cross Disaster Relief Fund

WASHINGTON, Sept. 2 /PRNewswire/ -- In response to the devastation caused by Hurricane Katrina, Lilly Endowment Inc. has donated $10 million to the American Red Cross Disaster Relief Fund. The Disaster Relief Fund provides food, shelter, counseling and other assistance to the victims of Hurricane Katrina and thousands of other disasters each year.

"For decades, the Lilly Endowment has been the premier supporter of American Red Cross disaster relief efforts. Their contribution today, as America faces its worst natural disaster ever, is another example of their great commitment to helping us help others. Lilly Endowment is the largest donor in American Red Cross history donating more than $50 million dollars to programs and services since World War II. The Endowment made two grants of $5 million during last year's hurricane season and also provided the initial funding for the Coordinated Assistance Network (http://www.can.org/) in the summer of 2004. That gift enabled the six CAN partner agencies to build an online victim case management system that is now being deployed nationally in response to Hurricane Katrina.

More than 200 emergency response vehicles (ERVs) and countless other Red Cross resources are on the scene to provide hot meals, snacks, bottled water and other much-needed relief supplies. In coordination with the Southern Baptists, we are serving more than 500,000 hot meals to storm-weary residents each day.

WASHINGTON, Sept. 2 /PRNewswire/ -- America's pharmaceutical research companies continue to send comprehensive disaster aid packages to public and private relief organizations to help lessen the suffering of survivors and to stem a looming public health crisis in the Gulf Coast region following Hurricane Katrina.

As of this afternoon, nearly $25 million in medicines, medical supplies and cash has been committed to relief efforts and that number is growing by the hour. In addition, this total does not include the commitment by many of PhRMA's member companies to "match" contributions from employees which continue to be sent in to charities supporting relief efforts. "America's pharmaceutical research companies will continue to provide medicines and money to help struggling, homeless people in the Gulf Coast as they did in the wake of the Asian tsunami. "This country must move immediately to complete the evacuation of all victims of Katrina in the New Orleans area by using every means, and any means, necessary to accomplish the job."

First $2 Million Pledged to Centers for Disease Control and Prevention Foundation to Fund Public Health Efforts in Gulf Coast

OAKLAND, Calif., Sept. 2 /PRNewswire/ -- Kaiser Permanente today announced a pledge of $3 million to fund hurricane relief efforts in the stricken Gulf Coast region. The first $2 million from Kaiser Permanente will go to launch the CDC Foundation's Hurricane Katrina financial response efforts in its drive to support public health department assistance in Louisiana, Mississippi and Alabama.

This initial pledge is part of a multi-pronged response by Kaiser Permanente to provide medical assistance to the large-scale natural disaster, according to George C. Halvorson, Kaiser Foundation Health Plan Inc., and Kaiser Foundation Hospitals chairman and chief executive officer, and The Permanente Federation Executive Director Francis J. Crosson, MD.

"We are humbled by the scope of this tragedy and feel compelled to be the initial donor to the CDC Foundation's vital effort addressing the public health needs of the Gulf Coast region," said Raymond J. Kaiser Permanente will be committing an additional $1 million in funds to long-term hurricane recovery relief. Hurricane Katrina - The Legal Saga Begins

The New Orleans tragedy may spawn a wave of litigation related to flood protection and levee failures. The first public statements which may serve as a foundation for massive public safety legal claims began on September 1st. The loss of life and catastrophic property damage is unprecedented -- thousands of lives lost or altered forever and a major American city uninhabitable for months or years. Based on the history of flood protection in the United States, it is clear that the Katrina disaster was both foreseen by safety experts and preventable had disaster warnings -- which started over 10 years ago -- been heeded. The scope of the New Orleans disaster has brought condemnation from flood damage experts and public officials. Just yesterday, Sen. John Breaux stated that "warnings were there" that a tragedy would happen. Louisiana experts have warned that this cataclysmic occurrence could occur without improvements in the New Orleans levee system.

It has long been common knowledge that a Category 4 or 5 hurricane could cause severe breaches in the levees. Prior floods along the Mississippi Delta have given local and national water protection officials direct evidence that it was only a matter of time before New Orleans would suffer a massive disaster. Since the Katrina disaster was not only predicted but scientifically proven to occur without safety upgrades, the onslaught of claims is both inevitable and justified. In fact, New Orleans was listed as one of the main foreseeable disaster areas after 9/11. Studies of security risks concluded that New Orleans was the most exposed metropolitan area in the country due to its geography and inadequate levee system. As the levees were built to protect the City up to a Category 3 hurricane, the flood prevention mechanisms were defective and inherently unsafe, especially in view of the predictable number of Category 4 and 5 hurricanes which occur every decade. With the increase in hurricane intensity the past few years, the failure to shore-up the levees when faced with a known danger of catastrophic proportions -- mass loss of life and risk to an entire city, one of our most historic places -- could mean a massive wave of litigation which will challenge the judgment of public and private entities for years to come.

The blame game has already started. The established record over the past few days could form the basis for flood protection liability claims that will range far and wide for years to come. The types of claims will cover loss of life, injury, insurable risks, commercial losses, property damage, business interruption, jobs lost, repair costs, disability claims, and virtually every type action allowed by our legal system. Based on sound legal principles, a wide variety of claims have been allowed against a variety of parties, including the Army Corps of Engineers, State Governments, public officials, construction companies, architects or design firms, and maintenance entities. Although the number of claims could be complex, the legal rules upon which they will be based are old and well-established -- dam and levee failures which cause major flooding have been brought against safety officials since the early 1900s. Virtually every major flood in the United States from a levee or dam failure has resulted in large legal claims and, in many cases, sizeable recoveries to disaster victims. In fact, a 1986 flood in California recently resulted in California being ordered to pay over $500 million to landowners affected by levee failures and it could wind up paying billions in future levee disasters. This type precedent could be applied to the New Orleans tragedy, but the consequences may be much larger -- economic devastation and loss of life may mean over $100 billion dollars in losses based on a recent assessment by Risk Management Solutions (RMS) of Newark, California.

Floods have played a major role in the evolution of mass disaster litigation. The public is acutely aware of the millions of dollars paid to dam or levee failure victims along the Mississippi River. Now the liability focus will turn to New Orleans. This tragedy may result in thousands of suits, including class actions and rulings that will affect public safety for years. The response by the legal community to the Katrina tragedy could be swift, and may result in recovery plans that rival, or even exceed, the 9/11 settlements, now recognized as one of the largest in history. Congress has approved disaster relief funding for FEMA, with $10 billion in initial expenditures for housing and emergency services. However, this type legislation will not provide compensation for the greatest needs of all -- funds for those who lost loved ones, homes, jobs and those who are injured. In the aftermath of 9/11, the U. S. Congress quickly passed authorization for a compensation fund that ended up paying over $10 billion to 9/11 victims. The New Orleans disaster may justify this type of federal intervention to give some systemic cushion or recovery option to death and injury victims who might otherwise swamp our legal system and bankrupt potential defendants. Even if this occurs, the 9/11 liability solution was only one of several options. Victims could accept federal awards or pursue other entities for full and just compensation.

The fault in levee failure cases normally focuses on the demonstration of a breach of basic safety standards, including: 1) the failure to maintain the levee to withstand a foreseeable flood surge; 2) the levee or its structures were designed or constructed in such a manner that it contributed to the levee's failure. These rules can apply to a public agency like the Army Corps or to private firms, like design and construction firms or repair, control or maintenance entities. Allegations of negligent design or maintenance are the main avenues of levee liability, according to J. David Rogers at the University of Missouri Department of Geological Engineering. See, "Flood Damage: Evolving Laws," by Prof. Rogers. A public agency like a flood control district or the Army Corps of Engineers must follow established safety rules, build and maintain a sound and secure levee system. "The fact that a levee fails is not standing alone sufficient to impose liability. However, where the public agency's design, construction or maintenance of a flood control project is shown to have posed an unreasonable risk of harm . . . the plaintiffs may recover," quoting case law in California. Legal rulings in favor of levee failure liability may open the door for victims in New Orleans to sue flood control agencies, municipal water agencies and a host of other public and private entities.

Although the most serious cases involve death and injury, it is easy to foreseen billions of dollars in property damage and commercial losses, such as cars, trucks and store merchandise destroyed in New Orleans. The system can expect contests over insurance coverage related to the buildings and homes that have been destroyed or damaged. Even if insurance does not apply, individuals and businesses might be able to sue flood prevention entities and private companies that were involved in designing, constructing and maintaining the levees. To cite a recent example, the 1997 New Year's Day flood in Marysville, CA, was caused by a levee break in the Feather River. Four people died and as much as $200 million in property damages occurred. At the time, TV coverage showed people and animals waiting on rooftops to be rescued. After eight years of litigation, the State of California agreed in July 2005, to pay $45 million to victims of the disaster. The settlement underscores the potential liability that governments and private agencies may face in the Katrina tragedy.

Katrina may also have an enormous impact on our political system as well. News reports may impact the Bush Presidency, both from the standpoint of how it responds to the disaster and how it cut funding for flood protection in New Orleans. Officials from both parties are already claiming that funding limits may have contributed to the disaster. Leaders are saying that had Washington heeded their warnings about the dire need for protection, such as building up the levees, the damage might not have been nearly as bad. This compelling history, together with the link between billions spent in Iraq and reductions in spending for flood protection, could further call into question the President's domestic and foreign policies. Local and national officials can likewise expect serious scrutiny into how they handle the tragedy. One Army Corps agent has already cast blame on the victims for failing to evacuate. This is harsh, perhaps unjustified, criticism from an entity that may have helped create the tragedy. Innocent citizens without the resources or means to evacuate should be protected, not victimized again by public comments. This size disaster can injure political careers and, hopefully, create new heroes on the national scene.

The destinies of many thousands of people ride on how the levees were implemented and how the rescue and relief efforts are being handled. The American system has vast resources and expertise; in time, the true victims -- those who lost loved ones & their standard of living -- will demand intervention from our legal system if our public and private entities fail to fairly compensate their losses. Justice demands that innocent victims be restored to their pre-disaster standard of living.

The Katrina Armageddon may force many victims to turn to our legal system for redress. Today, governmental assistance cannot provide comprehensive help. The judiciary, together with armies of lawyers, insurance agents and consumer groups can assist in handling thousands of mass tort claims, and courts can fashion resolution options, ranging from an award plan to emergency relief. Legal heirs and the injured should be afforded special rights, from choosing between a federal-state recovery fund and direct actions against the parties at fault. The Katrina legacy will also include changes in flood control systems, new water protection laws and reviews of our disaster and emergency response systems. In time, let's hope that much good from safety reforms comes from such a monumental and avoidable tragedy.

As the New Orleans saga plays out, our legal system could be stretched to its limits as it struggles to deal with the largest flood disaster in American history. Fortunately, the American system has remarkable resources, fortitude and resiliency. All of this and more will be needed to deal with the legal storm clouds now forming over New Orleans.

Privately-contracted helicopters move patients and staff at hospitals crippled by Hurricane Katrina

NASHVILLE, Tenn., Sept. 2 /PRNewswire-FirstCall/ -- HCA (NYSE:HCA) Twenty helicopters hired by Hospital Corporation of America (HCA) have completed the evacuation of patients and staff from Tulane University Hospital and Clinic, which began four days ago following Hurricane Katrina. The evacuation included close to 200 patients and over 1,200 employees and staff. HCA leadership, coordinating with Gov. Blanco's office, has offered the 20 helicopters at its expense to assist with the evacuation of nearby Charity Hospital's two facilities, as well as University Medical Center, which are not affiliated with HCA. As many as 50 Charity Hospital patients, some severely ill and on ventilators, have already been evacuated by HCA.

The evacuation process has consisted of a constant airlift using privately-contracted Blackhawk helicopters, Medi-vacs, passenger helicopters, and, with cooperation from government authorities, Chinook military aircraft. With each arrival, the helicopters dropped 750 pounds of food, water and medical supplies, filling the choppers with people for their return runs to the New Orleans airport, where buses wait ready to transport healthy individuals to shelter locations in Lafayette. Now the buses are taking people to HCA's Lakeview Hospital in Covington. Some patients have been transferred to hospitals in the area, and, in an effort to alleviate the local burden, others were transported to HCA facilities in Texas and Florida.

HCA has dozens of staff on the ground in New Orleans coordinating evacuation and relief efforts. Many have been in place since Katrina hit. Others, flown in on private aircraft from other HCA hospital locations, have arrived to support nursing and supply efforts in the area. Another 170 nurses are on stand-by through "All About Staffing", HCA's internally-run temporary nurse staffing organization. As the Tulane operation begins to wind down, the 20 helicopters the company had hired to assist in evacuating patients and staff are being maintained at HCA's expense to assist with the evacuations from Charity's two hospitals. Blackhawk helicopters will be used by HCA to provide food, water, and medical supplies for Charity Hospital's patients and staff. Some 150 employees from Chalmette were taken to an HCA-managed makeshift shelter in Lafayette.

"This situation demands we all do everything we can to help one another. We have use of these services, so it only makes sense that we keep these helicopters under contract in the air and provide help to other hospitals as best we can," said Jack O. Bovender, Jr., Chairman and Chief Executive Officer of HCA.

Earlier this week, HCA announced $2 million in cash donations, half of which would go to the American Red Cross for relief efforts, the other half to HCA's Hope Fund, to assist HCA personnel who have lost homes and belongings in the disaster. The company has pledged to maintain all 3,800 employees in the area on full salary indefinitely, and to arrange for them to find employment with other HCA facilities. Three other HCA hospitals in the region have been affected by the storm: all patients and staff from Lakeside Hospital in Metairie, Louisiana were evacuated earlier in the week; operations remain intact at both Garden Park Medical Center, in Gulfport, Mississippi and Lakeview Regional Medical Center, where evacuated patients and employees from Tulane are now being sent.

Public Service Electric and Gas crews left New Jersey Wednesday to help restore power in the Gulf Region

NEWARK, N.J., Sept. 2 /PRNewswire/ -- Public Service Enterprise Group (PSEG) today pledged to match employee and retiree contributions up to half a million dollars for Hurricane Katrina relief efforts. This gift, one of the largest in the New Jersey energy company's history, has the potential to amount to $1 million in aid. This support is in addition to the company's employee volunteers already en route to the disaster stricken area.

PSEG's utility subsidiary Public Service Electric and Gas (PSE&G) deployed some 90 electric delivery workers and two dozen work vehicles Wednesday to help restore power to the hard hit Gulf region. The contingent traveled 700 miles before arriving in Spartanburg, South Carolina last night and will travel another 500 miles today before reaching their destination in Alabama. PSE&G will concentrate their initial restoration efforts in Mobile, Alabama, in response to a call for help from Southern Company which has electric utilities in Alabama, Georgia and Mississippi.

PSEG's contributions will go to The Red Cross, The Salvation Army, America's Second Harvest, and a yet-to-be-named non profit organization providing relief in the Mobile area where PSE&G will helping to restore power.

New Jersey's Office on Volunteerism has said that monetary contributions are the best way to provide assistance. PSEG's sizeable financial contributions will allow professional relief organizations to purchase what is most urgently needed by disaster victims and to pay for the transportation to distribute supplies.

PSEG and its employees and retirees have a long history of providing help for families and communities in times of need.
